Tribunal Solicitors

There are various problems in employment that can occur at work that an employment solicitor can assist with, from health and safety issues to breakdown of working relationships. Discrimination and redundancy are just a few of the employment problems that can also lead to many disagreements and bad feelings at work, an employment solicitor can help you with these areas, and it might be that you consider an employment tribunal to hear your case fairly.

Severe employment disputes and grievances can sometimes lead to disciplinary procedures. However, employees sometimes disagree with the employment procedures or the result of the procedures and feel that they have been treated unfairly. In order to gain justice, there are several steps that can be taken both within an employment tribunal and within the place of employment itself.

ACAS run a dispute resolution service and an Early Conciliation. There is also a Judicial Mediation scheme, which is run by the Employment Tribunal service, in order to try and resolve a problem, before it reaches an Employment Tribunal. However, if none of these avenues have been successful the last result is taking the case to an Employment Tribunal.

In 2009/10 the most claims at an Employment Tribunal were under the working time directive, followed by unauthorised deductions. The third most popular accepted claim was unfair dismissal. Although these are the most common claims, Employment Tribunals accept claims for a whole host of issues. A full list of cases that can be bought before an Employment Tribunal and details of the relevant legislation can be found on the Justice website.

Making a claim at an Employment Tribunal can be a very daunting prospect for many individuals. Claims to Employment Tribunals are free of charge, however it is not uncommon for an Employment Tribunal to order a party to pay costs (known as expenses in Scotland), in the case of ‘unreasonable’ behaviour during a case. The maximum compensation that an employment tribunal can award an employee is £65,300.
